1. These terms
By placing an order you accept these terms. We may update them; the version that applies to your order is the one published when you placed it.
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law. Where any part of these terms conflicts with the Australian Consumer Law, the Australian Consumer Law applies.
2. The goods
Everything is made by hand. Brass is cast, finished and assembled individually. Leather is a natural material.
This means:
- No two pieces are identical
- Colour, grain, marking and finish vary between pieces and from photographs
- Brass develops a patina with wear and exposure. This is expected and is not a defect
- Leather will mark, soften and change with use
Photographs are accurate representations, not guarantees of exact appearance.
Made to order. Pieces are made after you order, and cut to the size you select. Nothing is pulled off a shelf. We dispatch within 5 business days.
Limited and ongoing pieces. Some pieces are made in limited runs and are not remade once the run is gone. Others are made on an ongoing basis. Each product page states which it is.
If a limited piece fails and the run is gone, there is nothing left to replace it with. For a major failure the choice is yours: reject the piece and take a refund, or keep it and be compensated for the drop in value. For a failure that is not major we will repair or refund it. Ongoing pieces can be replaced.
3. Prices and payment
Our prices are set in Australian dollars (AUD).
If you are shopping from outside Australia, prices may be shown converted into your local currency for convenience. Conversion rates are indicative and change. Prices for delivery to the United States are the exception: they are in US dollars, include US import duty (section 5), and are not a conversion of the Australian dollar price. The currency you are actually charged in is shown at checkout, and your bank or card issuer may apply its own rate or a foreign transaction fee. Neither is set by us.
We are not currently registered for GST. Prices do not include GST, and we do not issue tax invoices.
Payment is taken in full at checkout. We accept the payment methods shown at checkout: cards are processed by Stripe, and PayPal payments by PayPal. Payment in Monero is received directly by us. We do not receive or store your card details.
4. Orders
Placing an order is an offer to buy. We accept your order when we send confirmation that it has been dispatched, not when you receive the initial order-received email.
We may decline an order. Reasons include the piece being sold out, a failed payment, or a delivery address we cannot ship to. If we decline after payment, you get a full refund.
If anything in your order confirmation is wrong, contact us immediately. Once a piece has been dispatched we cannot change the address.
Pricing errors. If a price is listed incorrectly we will contact you before dispatch and you can confirm at the correct price or cancel for a full refund.
Cancelling. Because pieces are made to order, you can cancel for a full refund within 48 hours of placing your order. After that, materials have been cut to your size and the order cannot be cancelled.
Refunds paid in Monero. Where an order was paid in Monero, any refund is the same amount of Monero that was sent, not its dollar value on the day. Exchange rate movement between payment and refund is not adjusted for, in either direction. Monero refunds are sent manually to an address you give us.
5. Delivery
We ship from Adelaide, South Australia.
We cover shipping on every piece. Parcels require a signature, and are tracked where the service to your destination allows it.
We dispatch within 5 business days. Delivery estimates are shown on the Shipping page. They are carrier estimates, not guarantees. Once a parcel is with the carrier, timing is outside our control.
Risk passes to you on delivery. If a parcel arrives damaged, tell us within a reasonable time and keep the packaging.
International orders. Shipping is free. Outside the United States, import charges are not included. You are the importer. Customs duties, import taxes and clearance fees are your responsibility, are set by your own country, and cannot be calculated by us in advance. If a parcel is refused or abandoned at customs, we cannot refund the cost of getting it to you.
United States. Prices for delivery to the United States are in US dollars and include US import duty. We prepay the duty through Australia Post, so nothing more is charged on delivery. An order to the United States must be under US$2,450, which keeps it inside the limit for prepaying US import duty. If a US parcel is refused or not collected, the duty paid on it is not refunded by US Customs, and we cannot refund that part of the price.
6. Your rights under the Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
These rights are not limited by any time period stated elsewhere in these terms. How long goods should reasonably last depends on what they are. Our pieces are made to last years.
If something is faulty, message us through the contact form with your order number. We reply by email, and you can send photographs in reply. Do not post anything back before we send return instructions.
7. Change of mind
We do not accept change-of-mind returns. Every piece is made after you order and cut to the size you selected, so it cannot be resold.
This does not affect the rights described in section 6. If a piece is faulty, not of acceptable quality, or does not match its description, you are entitled to a remedy under the Australian Consumer Law regardless of anything in this section.
If you are unsure about sizing or specification, ask before ordering. We would rather answer questions than make the wrong piece.
8. Sizing
You choose the size. We cut the piece to it.
- Sizing instructions are on every product page. Follow them exactly
- Do not measure your waist. Measure a belt you already own and like the fit of
- Lay it flat and measure from where the pin rests on the front of the buckle frame, to the hole you use. That number, in centimetres, is your size
- Pick the closest size
- We restate your size in the order confirmation. Check it. If it is wrong, tell us within 48 hours and we will correct it, or cancel and refund
- After that we cut to the size you selected. If you selected the wrong size, the piece is not faulty, and we cannot remake or refund it. If you asked us which size to order and we told you the wrong one, that is our error. We will remake it or refund you, whichever you ask for
- If you are between sizes or unsure, ask through the contact form before ordering
If we cut a piece to a different size than the one you selected, that is our error. We will remake it or refund you, whichever you ask for.
9. Care
Care instructions are on the website. Damage caused by failing to follow them, by misuse, accident, or by normal wear and tear is not a defect.
10. Liability
Our goods come with the consumer guarantees described in section 6, and nothing here limits them.
Beyond those guarantees, and to the extent the law allows, we are not liable for indirect or consequential loss, and our total liability for any claim is limited to the price you paid for the piece.
Nothing in these terms limits our liability for death or personal injury.
11. Intellectual property
All designs, glyphs, names, photographs, video, and written material on this site belong to Kobamundii. Buying a piece does not transfer any rights to its design.
You may not reproduce, cast, copy or manufacture our designs, or use our images or world material commercially, without written permission.
12. Privacy
We handle your information as described in our Privacy Policy.
13. Governing law
These terms are governed by the laws of South Australia. Disputes go to the courts of South Australia. This does not affect any right you have to bring a claim in your own jurisdiction where the law gives you that right.
